3.1. Eligibility: You must be at least 18 years of age or the legal age of majority in your jurisdiction to use our services. By using our services, you represent and warrant that you have the legal capacity to enter into this agreement.

3.2. Acceptance: By using CyParks Email Services, you agree to be bound by these Terms, the Privacy Policy, and any other policies, guidelines, and conditions referenced herein. If you do not agree with these Terms, please refrain from using our services.

4. Account Registration and Use

2.1. Account Creation: To use our services, you must create an account with our assistance. You are responsible for maintaining the confidentiality of your account credentials, and you are solely responsible for all activities that occur under your account.

2.2. Compliance with Laws: You agree to use our services in compliance with all applicable laws, regulations, and these Terms. You may not use our services for any illegal or unauthorized purpose, including but not limited to, the following:

You represent and warrant you have all rights necessary to upload or transmit User Content and that it does not violate any law or these Terms. We have no obligation to monitor User Content. However, we have the right to review, block, or remove User Content at any time if we deem it objectionable or in violation of these Terms.

2.4. Email Address Usage: You may only use email addresses that have been approved by CyParks Email Services to send emails. Unauthorized use of email addresses, including those ending with our domain name “CyParks.com,” is strictly prohibited.

2.5. Unlimited Subscribers: While we do not impose limits on the number of subscribers, you must manage your subscriber list effectively and ensure compliance with these Terms and any relevant data protection laws.

  1. Account Suspension or Termination

We may suspend or terminate your access to our Services immediately if we determine:

  • You have violated these Terms, applicable law, or engaged in illegal or improper use of our Services.
  • Complaints exceeding 3% in your account. Accounts exceeding this threshold may be subject to suspension or banning at our discretion.
  • You are sending emails from addresses not approved by us or containing our domain name without authorization.

6.1. Account Termination

We reserve the right to terminate or suspend your account at our discretion, with or without cause, at any time. In case of account termination, you may lose access to your data and content. You may terminate your account at any time by contacting our Support team.

7. Payment and Billing

7.1. Pricing and Fees: CyParks Email Services may charge fees for certain features and services. These fees are specified on our website and are subject to change. By using our services, you agree to pay all applicable fees.

7.2. Refunds: We offer a 100% Money-back Guarantee on all paid fees, except for residual payment after or upgrade.

8. Intellectual Property

a. We own all right, title, and interest in and to the Services, including all intellectual property rights therein.

b. You own all rights, titles, and interests in and to your Content.

c. You grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, distribute, modify, and otherwise exploit your Content in connection with the provision of the Services

10. Disclaimer of Warranties

THE SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. WE MAKE NO WARRANTIES, EXPRESS OR IMPLIED, WITH RESPECT TO THE SERVICES, INCLUDING BUT NOT LIMITED TO ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICES.

These Terms constitute the entire agreement between you and us with respect to the Services and supersede all prior or contemporaneous communications and agreements, whether oral or written.

14. Severability

If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck from these Terms and the remaining provisions shall remain in full force and effect.
